In a recent federal court ruling, Apple was found guilty of willfully violating a 2021 court order prohibiting it from restricting app developers from informing users about alternative payment options outside the App Store. The ruling marks a significant victory for Epic Games, the creator of Fortnite, and is potentially a game-changer for all app developers.
What did the court decide?
Judge Yvonne Gonzalez Rogers said Apple knowingly violated the regulation by:
- It introduced a 27% fee for purchases made outside the App Store, bypassing the original 30% commission ban.
- It displayed "warning screens" (so-called scare screens) intended to discourage users from using external payment methods.
The judge also charged Apple's financial vice president, Alex Roman, with perjury and referred the case to federal prosecutors for possible criminal prosecution.
Apple and Epic Games' response
Apple disagrees with the court's decision and plans to appeal it. CEO Tim Cook said the company "complied with the court's order" and will defend itself legally.
On the other hand, Epic Games CEO Tim Sweeney announced that Fortnite will return to the US App Store. He also offered a “peace proposal”: if Apple expands the seamless and free framework globally, Epic will drop all current and future lawsuits on the subject.
